  c. "Personal Data & Privacy Statement" shall mean Mannings’ policy regarding personal data collected in connection with this site and Mannings’ policy regarding the privacy of customers and visitors to the site.

1.2   These Terms and Conditions include Legal Notice and Disclaimer and Personal Data & Privacy Statement and shall prevail over any other document including any Mannings store policy purporting to have a contractual effect.
1.3   You agree to provide the complete and updated information for registration on this site.
1.4   Mannings has the absolute discretion to refuse registration of any applicant and to terminate the registration of such applicant for any reason whatsoever.
 
2. VARIATION OF TERMS AND CONDITIONS

2.1   Mannings reserves the right to amend these Terms and Conditions in its sole discretion. Customers and visitors are reminded to review the Terms and Conditions.
 
3. PREVALING LANGUAGE

3.1   In the event of any discrepancy in the translation of this text, the English version shall prevail.
 
4. APPLICABLE LAW

4.1   These Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region and the Customer and Mannings agree to submit to the jurisdiction of the Hong Kong courts.
 
5) TYPES OF PERSONALLY INDENTIFIABLE INFORMATION COLLECTED
 
    At times, you may be required to give your personally identifiable information including, but not limited to, your name, gender, age, part of identity document number, telephone number, fax number, home address, email address, and health concern etc. Refusal to provide such information may deny you of access to certain parts of this site, or may render us unable to handle any application or request you are making. If you are under the age of 18, consent from your parent or guardian is required before you give us any personally identifiable information.

Mannings Mann Card Programme
Terms & Conditions

1. Programme effective date
  The Mann Card Program shall commence on 2 July 2010 and these Terms and Conditions are effective from the said date.
 
2. Application
 
  2.1. These Terms and Conditions form the agreement between you, our Member, and us, The Dairy Farm Company Limited. We will have other merchants to join the Program in the near future (“Our Partners”) offering you more rewards and targeted offers.
 
  2.2. In these Terms and Conditions, meaning of certain terms shall be as follows:
    a. “Member” - a member of the Mann Card Program.
    b. “Membership card”: - means the membership card issued to you to enjoy your benefits under the Program upon your successful registration.
    c. "Mini Card" - means the supplementary card of the membership card.
    d. "Our Stores" or “Retail Outlets” – Mannings stores in Hong Kong.
    e. “Basic Point” – elementary points awarded to you based on the invoice amount when you make purchases at the Retail Outlets.
    f. “Bonus Point” – additional points awarded to you based on the net purchase amount of specific promotional product when you make purchases at the Retail Outlets.
    g. “Points” – Basic and/or Bonus Points awarded to you upon purchases at the Retail Outlets.
    h. "Mann Card Service Hotline" – 22993381 (Mannings) or such telephone number as notified by us from time to time.
    i. "Mann Card Website" – www.mannings.com.hk
    j. “Personal Data” - means any data
     
  		• related directly or indirectly to a living individual;
         
  		• (b) from which it is practicable for the identity of the individual to be directly or indirectly ascertained; and
         
  		• (c) in a form in which access to or processing of the data is practicable;
         
  		• 'Personal data' is taken to include information held in computer files, paper-based systems, magnetic recordings and micro-forms systems.
        k. “Our Partners” – separate independent commercial entities providing goods or services to Mannings.
     
    3. Membership application
      3.1. Applicants must spend a specific amount of Hong Kong dollars or above in one invoice at the retail outlet as determined by Mannings and complete an application form providing certain personal data.
     
      3.2. Applicants must be of age 18 or above.
     
      3.3. The information you provide us when you register as a Member, will help us and Our Partners to make carefully selected offers that may be of interest and value to you.
     
      3.4. Each Member will be issued with a main Membership Card and two (2) Mini Cards. They offer exactly the same functions and are linked to one account. The Mini Cards may be used by members of your family to earn and accumulate Points to your Mann Card account.
     
      3.5. Member can start to earn points upon the issuance of membership card.
     
      3.6. Member can make enquiry of the membership at least 30 days upon enrollment at stores.
     
      3.7. We may decline your application under the circumstances as may be determined by us in our sole discretion.
     
      3.8. The application for the membership is validated based on specific transaction amount of a single purchase. The transaction amount is the net purchase amount after all discounts. It excludes purchase of Gift Voucher, Gift cards, Stamp/Points redemption items, EPS Easy Cash, Octopus value-adding, and Plastic Shopping Bag Levy. Return of cards and memberships are required upon refund or return of items.
     
    4. The Programme, reward and special offer
      4.1. One Basic Point will be credited to your account for every $5 dollars spent. Bonus Points may be issued on bonus promotional products.

    Transaction fulfilling the minimum spending amount for membership eligibility is not valid for points earning. Basic points will be calculated based on the net purchase amount after all discounts. Purchases made towards Manning gift vouchers, GiftCards, Octopus value-add, EPS Easy Cash, Plastic Shopping Bag Levy, redemption of stamp promotion and redemption of rewards are not eligible for point earning.
     
      4.2. Points will be awarded and updated within 5 days from the date of your purchase. You may check your point balance at Mann Card Website, or by calling the Member Hotline, or by presenting your Mann Card at stores.
     
      4.3. Points are valid till 30th September of each year. Unused Points will expire automatically. For points earned from 1st July, they will be expired on 30th Sept in the following year. The first bonus point cut-off date is 30 September 2011.
     
      4.4. From time to time, Points may not be issued for the purchase of certain commodities or services, or when you are entitled to some other benefits or when you are also a member of other programs. Notices of such restrictions will be posted on the Mann Card Website and/or in the Retail Outlets for your information.
     
      4.5. Points will be deducted for cases of product refund.
     
      4.6. Point balance shown on purchase receipt is as of the last calendar day.
     
      4.7. Last 10 transactions are shown on Mann Card Website. Transaction records or history will NOT be provided in a printed version.
     
      4.8. All offers of the Program may be changed from time to time without prior notice.
     
      4.9. Upon accumulating certain points, you may redeem for rewards. Voucher based rewards will be mailed to your registered mailing address. Other rewards will be collected at selected Stores upon presentation of your Mann Card and a redemption letter. Rewards not collected by the expiry date printed on the Redemption Letter will be forfeited. Points for expired redemption rewards will not be refunded.
     
      4.10. In addition to your Mann Card, you may be required to present other identification for verification of your identity when you use your Mann Card.
     
      4.11. Benefits, including Points issued during one-off promotion (e.g. during Our Partners' launch) will be governed by the rules of the specific promotion and may expire after the end of that promotion.
     
      4.12. Members can enjoy extra 5% off on Mann Card Day (10th every month).The discount is not applicable to the purchase of CWG, Fixed price items, Gift Voucher, Gift cards, Infant and Children Milk powder, Baby Diapers, Phone Cards, Counters/Pharmacy Counter Products, Stamp/Points redemption items, EPS Easy Cash, Octopus value-added and Plastic bag levy.
     
    5. Malfunction / Loss of membership card
      5.1. If your Mann Card malfunctions due to no fault of yours and you have not damaged or tampered with it in any way, you may recover your points by returning the damaged card to the Mann Card Customer Service Department by mail.
     
      5.2. You should notify us immediately by calling the Mann Card Service Hotline if your Mann Card has been lost or stolen. We shall not be responsible for any loss (including Points) suffered by you in relation to your lost card.
     
      5.3. In determining the remaining amount of Points to be transferred to your replacement Mann Card, the records held by us shall be deemed conclusive evidence of the amount of the remaining Points.
     
      5.4. Mannings reserves the right to charge for a replacement card.
     
    6. Return or Cancellation of your Membership
      6.1. If you return (other than due to malfunction as described under clause 5.1) or cancel your Mann Card Membership, the Points as recorded on your Mann Card will be forfeited and your Membership will be terminated.
     
    7. Others
      7.1. In the event that your Mann Card is not used for a specified period (currently, 365 days), we will, for your own and our protection, deem your Mann Card to be no longer in use, and we will deactivate your Mann Card and all your accumulated Reward Points will be forfeited. You may need to reapply for a new Membership if you wish to rejoin the Programme.
     
      7.2. At times, Mann Card Website and Service Hotline may not operate during nightly update batches, breakdown of communication networks, electricity networks, etc. It will resume soonest after the scheduled maintenance or breakdown.
     
      7.3. Points, offers and membership cards are not transferrable.
     
      7.4. Points or any kind of offers, benefits are personal to an individual Member and cannot be transferred. You should not transfer your Mann Card, your Membership's benefits to any other person.
     
      7.5. We may provide you with new services associated with your Membership from time to time, and these new services will be governed by these Terms and Conditions and the terms and conditions of the respective services.
     
      7.6. If we are going to terminate the Program, we shall give you at least three (3) months notice by display at our Stores, as well as in the Mann Card Website. Rewards not collected by the termination date will be forfeited and will not be refunded.
     
      7.7. If you breach or if we have reasonable ground to believe that you have breached these Terms and Conditions, we may suspend or terminate your Membership and seek to recover any damages that your breach may have caused to us or Our Partners.
     
      7.8. We may make changes to these Terms and Conditions from time to time without prior notice to you. A copy of the latest version of these Terms and Conditions will be available on the Mann Card Website.
     
    8. Personal Data and information
      8.1. In order for you to become a Member of the Program, it is necessary for you to provide us with your personal information ("Personal Data"). If you are unable or unwilling to provide us with complete and correct Personal Data, we may not be able to provide or continue to provide the services under the Program to you.
      8.2. All information is managed in accordance with Mannings’ Privacy Policy which are posted at www.mannings.com.hk. Such policy is deemed incorporated into these terms and conditions.
     
    9. English Version Prevails
      If there is any inconsistency or conflict between the English and the Chinese versions, the English version shall prevail.
     
    10. Governing Law
      These Terms and Conditions shall be governed by the laws of Hong Kong SAR.
